Terms and Conditions of Sale

ARTICLE 1 – PURPOSE AND SCOPE

These General Terms and Conditions of Sale (hereinafter “GTC”) apply, without restriction or reservation, to all sales made by Christina Winkler’s sole proprietorship (hereinafter “the Service Provider”) to non-business or business customers (hereinafter “the Customer”) who wish to purchase the training and course services offered on the website https://mtcgestalt.com/.

The services offered for sale are as follows:

  • Online training and courses (e-learning);
  • Online courses and sessions via videoconferencing;
  • In-person classes, workshops, and training sessions.

ARTICLE 2 – NATURE OF THE SERVICES AND CLINICAL WARNINGS

The online courses offered are designed for educational, informational, and personal development purposes. Under no circumstances do they constitute:

  • an act of psychological care, diagnosis, or treatment;
  • individualized treatment monitoring;
  • a substitute for a consultation with a healthcare professional.

The Client acknowledges that the content provided is for general informational purposes only and is not a substitute for individualized clinical advice. In the event of a medical or psychiatric emergency, the Client is advised to contact emergency services (15, 112) or any qualified healthcare professional.

The Service Provider agrees to comply with the Code of Ethics for Psychotherapy Practitioners, particularly with regard to confidentiality, including during any interactions among participants (forums, group sessions, Q&A sessions).

ARTICLE 3 – RATES AND PAYMENT TERMS

Service rates are listed on the website in euros (€), including all taxes (TTC). The Service Provider reserves the right to change its prices at any time; however, the price listed on the website on the day the order is placed will be the only price applicable to the Customer.

Payment is due immediately upon placing an order. Payments for purchases are processed through the following secure platforms:

  • Stripe (credit card)
  • PayPal

By providing their banking information, the Customer authorizes the Service Provider to charge their card or account the amount corresponding to the stated price.

ARTICLE 4 – DURATION OF ACCESS TO SERVICES (E-LEARNING)

For purchases of online training courses (e-learning), access to digital content (videos, documents, course materials) is guaranteed for a period of three (3) years from the date the payment is confirmed. After this 3-year period, the Customer’s access will be automatically suspended.

ARTICLE 5 – RIGHT OF WITHDRAWAL AND CANCELLATION POLICY

In accordance with French law, the rules regarding the right of withdrawal vary depending on the nature of the service purchased:

5.1. For online courses (E-learning / Digital Content)

In accordance with Article L.221-28(13) of the Consumer Code, the 14-day right of withdrawal cannot be exercised for the supply of digital content not provided on a tangible medium, where performance has begun after the consumer’s prior express consent and express waiver of their right of withdrawal.

Consequently: By checking the waiver box when placing an order and immediately accessing the e-learning courses, the Customer agrees to the immediate performance of the service and expressly waives their right of withdrawal. No refund or partial refund will be granted.

5.2. For videoconference classes and in-person classes (Provision of Services)

For live (video) or in-person course services, the Customer has a statutory right of withdrawal of 14 days from the date the contract is concluded (order confirmation).

  • If the class takes place after the 14-day period: The customer may exercise their right of withdrawal by sending a written notice to contact@mtcgestalt.com and receive a full refund.
  • If the course takes place or begins before the end of the 14-day period: A Customer who expressly requests that the service be performed before the end of the period retains the right to cancel, but must pay the Service Provider an amount proportional to the service provided up to the time of cancellation. If the session or course is completed in full before the end of the 14-day period, the right of withdrawal is forfeited.

5.3. Cancellation Policy (Outside the Cooling-Off Period)

For any cancellation or request to reschedule a video or in-person class outside the scope of the right of withdrawal:

  • Cancellation more than 48 hours before the class: The class may be rescheduled at no charge.
  • Cancellation less than 48 hours before the class (or failure to attend): The full class fee is due and will not be refunded or rescheduled.

ARTICLE 6 – LEGAL NOTICE AND LIABILITY

The Service Provider’s business is registered under APE code 86.90F (Human Health Activities Not Elsewhere Classified) and includes wellness coaching, training, and personal development services [Gestalt TCM].

Important: The classes, techniques taught, and advice shared do not constitute medical or paramedical practice under any circumstances. They are in no way a substitute for medical advice, diagnosis, or treatment. The Client is encouraged to consult a general practitioner or specialist for any questions regarding their physical or mental health.

ARTICLE 7 – CONSUMER MEDIATION

In accordance with Articles L.612-1 et seq. of the Consumer Code, the consumer-customer has the right to seek the assistance of a consumer mediator, free of charge, to reach an amicable resolution of any dispute between the customer and the Service Provider.

ARTICLE 8 – GOVERNING LAW

These Terms and Conditions and any transactions arising therefrom are governed by French law. In the event of a dispute, an amicable resolution will be sought before any legal action is brought before the competent courts.
